1. Acceptance of Terms
By accessing or using MedPilot.app (“Service”), you agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service. These Terms apply to all users, including healthcare providers, staff, and organizations (“Users”).

 2. Eligibility
To use the Service, you must:
– Be at least 18 years old.
– Represent a legitimate healthcare practice or entity.
– Comply with all applicable laws, including HIPAA, GDPR, and HITRUST.

3. Account Registration
– Accuracy: Provide accurate and complete registration information.
– Security: You are responsible for maintaining account confidentiality and all activities under your account.
– Reporting: Notify MedPilot immediately of unauthorized use or breaches.

4. Service Description
MedPilot provides cloud-based medical practice management software, including:
– Electronic Health Records (EHR) and patient scheduling.
– Telehealth, e-prescriptions, and medical billing tools.
– Compliance, analytics, and third-party EHR integrations (e.g., Epic, Cerner).

5. Subscription & Payments
– Fees: Subscription fees are billed monthly or annually, as selected. Fees are non-refundable.
– Taxes: Users are responsible for all applicable taxes.
– Changes: MedPilot reserves the right to modify pricing with 30 days’ notice.

6. User Responsibilities
You agree to:
– Use the Service only for lawful purposes and in compliance with healthcare regulations.
– Obtain patient consent for telehealth visits and data sharing.
– Not reverse-engineer, resell, or exploit the Service for commercial purposes beyond licensed use.

7. Data Privacy & Security
– PHI Compliance: MedPilot adheres to HIPAA and GDPR standards for Protected Health Information (PHI). Users are responsible for PHI they input.
– Encryption: Data is encrypted in transit and at rest.
– Audits: MedPilot conducts annual third-party security audits.

8. Intellectual Property
– Ownership: MedPilot retains all rights to the software, trademarks, and content.
– User Data: Users own their patient data but grant MedPilot a license to process it for Service delivery.

9. Termination
– By User: Cancel anytime via your account dashboard.
– By MedPilot: We may suspend or terminate accounts for breaches of these Terms, with or without notice.
– Effect: Termination voids access to data; users may request data export (in standard formats) prior to termination.

10. Limitation of Liability
– No Warranty: The Service is provided “as is.” MedPilot disclaims all warranties, including fitness for a particular purpose.
– Liability Cap: MedPilot’s liability is limited to fees paid by the User in the 12 months preceding a claim.
– Indirect Damages: We are not liable for lost profits, data, or indirect damages.

11. Governing Law
These Terms are governed by the laws of [Insert State/Country], without regard to conflict of laws principles. Disputes will be resolved in courts located in [Insert Jurisdiction].

12. Changes to Terms
